JURY TRIAL: CLEAR & CONVINCING EVIDENCE

The party with the burden of proof in a civil action (e.g., the plaintiff or cross-complainant) may sometimes be required to prove a fact by clear and convincing evidence. To meet this burden, the jury must be persuaded, by the evidence in court, that it is highly probable that the fact to be proven is true.
